This Privacy Policy and its Addendum(s) ("Policy") outlines how 1app (collectively "1app", " we", "us" or "our "), associated companies, affiliates, and jointly managed entities utilize, process, collect, and disclose your Personal Data through the use of 1app's mobile applications and websites services (such as "Apps" and "websites"), as well as products, features, and other services operated by 1app.
This Policy applies to our users, merchants, customers, passengers, agents, suppliers, drivers, vendors, contractors, Service Provider partners, and other various partners (collectively " you," " your" or " yours").
"Personal Data" is any information that can be used to identify you or from which you are identifiable. This includes but is not limited to your name, nationality, telephone number, email address, race, date of birth, personal interests, picture, government-issued identification numbers, bank, vehicle, and credit card details.
1. COLLECTION OF PERSONAL DATA
1.1. 1app collects Personal Data in various ways indicated below.
1.2. 1app collects your Personal Data when you voluntarily provide it to us. For example, you may provide your Data to us when you:
1.2.1. verify your identity through various means (such as social media logins, submission of selfie images);
1.2.2. participate in contests or events organized by us (such as the pictures, audio files, or videos you may submit, which may include images of yourself);
1.2.3. complete a user profile or registration forms (such as your name, contact information, and other identification information where needed); and
1.2.4. provide information to assess your eligibility to provide services as a 1app driver-partner or driver partner (such as your driver's license information, vehicle information, and background check results (as legally permissible));
1.3. In certain circumstances, you may need to provide your Personal Data to comply with legal requirements or contractual obligations or where it is necessary to conclude a contract. Failure to provide such Personal Data, under such circumstances, may constitute a failure to comply with legal requirements or contractual obligations or an inability to conclude a contract with you.
2. Using 1app Services
2.1. Personal Data may be collected through the regular operation of our Apps, websites, and Services. Some examples are:
2.1.1. personal data you enter in messages when you use our in-app communication features;
2.1.2. transaction information (such as payment method and distance traveled);
2.1.3. information about how you interacted with our Apps, website, or Services (such as features used and content viewed);
2.1.4. your location (to detect pick-up locations and abnormal route variations);
2.1.5. personal data that may be captured through your interaction with us.
2.1.6. device information (such as hardware model and serial number, IP address, file names, and versions and advertising identifiers or any information that may indicate device or app modification); and
2.1.7. feedback, ratings, and compliments.
3. Data From partners and other sources
3.1. When 1app collects Personal Data, including but not limited to your name, contact information, and other identification information where needed from other sources, 1app makes sure that that data is transferred to us according to applicable laws. Such sources include:
3.1.1. business partners, such as fleet partners, payment providers, driver-partners and transport partners;
3.1.2. insurance and financial providers;
3.1.3. governmental authorities of data;
3.1.4. referral programs;
3.1.5. publicly available sources of data; and
3.1.6. marketing services providers or partners.
4. Personal Data about driver-partners
4.1. If you are a driver-partner, 1app may collect:
4.1.1. device data (such as accelerometer data, GPS location, your IMEI number and the names of apps you have installed on your device);
4.1.2. telematics data (such as your speed, acceleration, and braking data);
4.1.3. personal data that may be captured through your interaction with us; and
4.1.4. your vehicle registration data.
5. Personal In-vehicle cameras
5.1. Some 1app partners may install personal in-vehicle cameras in their vehicles for their own purposes (including safety and security). The use of such in-vehicle cameras is not endorsed or prohibited by 1app. The relevant partner's responsibility is to collect, use, and disclosure of Personal Data obtained from personal in-vehicle cameras. Please check with a suitable partner if you have any queries about their use of personal in-vehicle cameras.
6. Personal Data of minors
6.1. As a parent or legal guardian, please do not allow minors under your care to submit Personal Data to 1app. If such Personal Data of a minor is disclosed to 1app, you hereby consent to the minor's Personal Data processing and accept and agree to be bound by this Policy and take responsibility for his or her actions.
7. DISCLOSURE OF PERSONAL DATA
7.1. 1app needs to share Personal Data with various parties for the Purposes. These parties include:
7.2. Third parties
7.2.1. For example, 1app may share a vehicle's location and driver's and/or passenger's name with third parties when a passenger uses the "Share My Ride" feature or activates the Emergency Button.
7.3. Other users
For example:
7.3.1. If you are a driver-partner, 1app may share your Personal Data with your selected merchant and user, including your name and photo; your vehicle make, model, location, and average rating.
7.3.2. If you are a driver-partner, 1app may share your Personal Data with your passenger, including your name and photo; your vehicle make, model, number plate, location, and the average rating.
7.3.3. If you are a passenger, 1app may share your pick-up and drop-off locations with our driver-partner fulfilling your service request.
7.3.4. Suppose you are using our 1app Delivery service. In that case, 1app may share your Personal Data with the recipient of your parcel, and vice versa, as well as the driver-partner in charge of fulfilling your service request.
7.3.5. If you use our in-app chat service, 1app may share your mobile number and 1app-registered name with the other parties to your chat.
7.4. With 1app partner at your request
7.4.1. For example, suppose you requested a service through a 1app partner or used a promotion provided by a 1app partner. In that case, 1app may share your Personal Data with that 1app partner. Our partners include partners that integrate with our App or our App integrates with vehicle services partners, or business partners which 1app collaborates with to deliver a promotion, competition or other specialized Service.
7.5. The owner/employer of 1app accounts that you (user) may use
7.5.1. For example, your employer may receive trip data when you use your employer's 1app for Business account.
7.6. Subsidiaries and affiliates
7.6.1. 1app shares Personal Data with our subsidiaries, associated companies, jointly controlled entities and affiliates.
7.7. 1app's service providers and business partners
7.7.1. 1app may provide Personal Data to our vendors, consultants, marketing partners, research firms, and other service providers or business partners. This includes:
7.7.1.1. fleet and merchant partners;
7.7.1.2. insurance and financing partners;
7.7.1.3. credit bureaus and other credit reporting agencies;
7.7.1.4. background check and anti-money laundering service providers
7.7.1.5. data analytics providers;
7.7.1.6. research partners, including those performing surveys or research projects in partnership with 1app or on 1app's behalf;
7.7.1.7. service providers who perform identity verification services; and
7.7.1.8. vehicle solutions partners, vendors or third-party vehicle suppliers.
7.7.1.9. payment processors and facilitators; and
7.7.1.10. debt collectors.
7.8. 1app's legal advisors and governmental authorities
7.8.1. 1app may share your Personal Data with our legal advisors, law enforcement officials, government authorities, and other third parties. This may take place to fulfill the legal purposes (mentioned above), or under any of the following circumstances:
7.8.2. where it is necessary to respond to an emergency that threatens the life, health or safety of a person; or
7.8.3. where it is necessary in the public interest (e.g. in a public health crisis, for contact tracing purposes and safeguarding our community).
8. 1app's USE OF PERSONAL DATA
8.1. 1app may use, combine and process your Personal Data for the following purposes ("Purposes"):
9. Safety and security
9.1. 1app uses your data to ensure the safety and security of our Services and all users. This includes:
9.1.1. detecting, preventing and prosecuting crime.
9.1.2. verifying your identity when you log in to 1app;
9.1.3. sharing drivers and passengers' location and details when the emergency button or the "Share My Ride" feature is activated;
9.1.4. monitoring compliance with our terms and conditions, policies and Driver's Code of Conduct;
9.1.5. using the device, location, profile, usage and other Personal Data to prevent, detect and combat fraud or unsafe activities;
9.1.6. screening driver and driver-partners before enabling their use of our Services; and
9.1.7. identifying unsafe driving behavior such as speeding, harsh braking and acceleration, and providing personalized feedback to driver-partners.
10. Customer Support and Assistance
10.1. 1app uses Personal Data to resolve customer support issues. For example, 1app may:
10.1.1. monitor and improve our customer support responses;
10.1.2. investigate and address concerns;
10.1.3. inform you about steps taken to resolve customer support issues; and
10.1.4. respond to questions, comments and feedback.
11. Legal Use
11.1. 1app may use the Personal Data 1app collect to investigate and resolve claims or disputes, or as allowed or required by applicable law.
11.2. 1app may also use your Personal Data in connection with mergers, acquisitions, joint ventures, sale of company assets, consolidation, restructuring, financing, business asset transactions, or acquisition of all or part of our Business by another company.
11.3. 1app may also use your Personal Data when 1app are needed, advised, recommended, expected or requested to do so by our legal advisors or any local or foreign legal, regulatory, governmental or other authority. All suits arising out of this Agreement shall be filed with/in the proper Courts of Quezon City. For example, 1app may use your Personal Data to:
11.3.1. comply with court orders or other legal, governmental or regulatory requirements;
11.3.2. enforce our Terms of Service or other agreements; and
11.3.3. protect our rights or property in the event of a claim or dispute.
12. Providing services and features
12.1. Your Personal Data will be used to provide, personalize, maintain and improve our Apps, Websites and Services. This includes using your Personal Data to:
12.1.1. perform internal operations necessary to provide our Services, including troubleshooting software bugs and operational problems, conducting data analysis, testing and research, monitoring and analyzing usage and activity trends;
12.1.2. offer, obtain, provide, facilitate or maintain insurance or financing solutions;
12.1.3. enable features that personalize your App, such as lists of your favorite places and previous destinations;
12.1.4. create, administer and update your account;
12.1.5. validate your ride and process payments;
12.1.6. fulfill the services to you as a data processor, where you have provided consent to the data controller (i.e. the organization you had purchased goods or services from, and for whom 1app is providing services on behalf) for such services to be rendered;
12.1.7. make your experience more seamless, such as automatically filling in your registration information (such as your name or phone number) from one Service to another Service or when you participate in our surveys;
12.1.8. protect the security or integrity of the Services and any facilities or equipment used to make the Services available;
12.1.9. conduct due diligence checks;
12.1.10. provide you with Services across our various business verticals;
12.1.11. engage you to provide Services;
12.1.12. verify your identity;
12.1.13. verify your age (where necessary);
12.1.14. track the progress of your trip and detect abnormal trip variations;
12.1.15. process and manage your rewards;
12.1.16. enable our partners to manage and allocate fleet resources;
12.1.17. process, manage, or verify your application of promotions, rewards, and subscriptions with 1app.
13. Research and development and security
13.1. 1app may use the Personal Data 1app collect for testing, research, analysis, and product development. This allows us to understand and analyze your needs and preferences, protect your Personal Data, improve and enhance our Services' safety and security, develop new features, products and services, and facilitate insurance and finance solutions.
14. Marketing and promotions
14.1. 1app may use your Personal Data to market 1app and 1app's partners', sponsors' and advertisers' products, services, events or promotions. For example, 1app may:
14.1.1. notify, invite and manage your participation in our events or activities; and
14.1.2. send you alerts, newsletters, updates, mailers, promotional materials, special privileges, and festive greetings.
14.2. 1app may communicate such marketing to you by post, telephone call, short message service, online messaging Service, push notification by hand and by email.
14.3. If you wish to unsubscribe to the processing of your Personal Data for marketing and promotions, please click on the unsubscribe link in the relevant email or message. Alternatively, you may also update your preferences in our App settings.
15. COOKIES AND ADVERTISING ON THIRD-PARTY PLATFORMS
15.1. 1app, and third parties with whom 1app partner, may use cookies, 1appb beacons, tags, scripts, local shared objects such as HTML5 and Flash (sometimes called "flash cookies"), advertising identifiers (including mobile identifiers such as Apple's IDFA or Google's Advertising ID) and similar technology (" Cookies") in connection with your use of the websites and Apps. Cookies may have unique identifiers and reside, among other places, on your computer or mobile device, in emails 1app send to you, and on our 1appb pages. Cookies may transmit Personal Data about you and your use of the Service, such as your browser type, search preferences, IP address, data relating to advertisements that have been displayed to you or that you have clicked on, and the date and time of your use. Cookies may be persistent or stored only during an individual session.
15.2. 1app may allow third parties to use Cookies on the websites and Apps to collect the same type of Personal Data for the same purposes 1app does for itself. Third parties may associate the Personal Data they collect with other Personal Data they have about you from other sources. 1app does not necessarily have access to or control the Cookies they use.
15.3. Suppose you do not wish for your Personal Data to be collected via Cookies on the websites. In that case, you may deactivate cookies by adjusting your internet browser settings to disable, block or deactivate cookies by deleting your browsing history and clearing the cache from your internet browser. You may also limit our sharing of some of this Personal Data through your App (Settings > Privacy > Ads) and mobile device settings.
15.4. Additionally, 1app may share non-personally identifiable Personal Data with third parties, such as location data, advertising identifiers, or a cryptographic hash of a joint account identifier (such as an email address), to facilitate the display of targeted advertising on third-party platforms.
16. User's rights with respect to personal data
16.1. In accordance with applicable laws and regulations, you may be entitled to:
16.1.1. request the correction and/or (in some cases) deletion of your Personal Data;
16.1.2. ask us about the processing of your Personal Data, including to be provided with a copy of your Personal Data;
16.1.3. complain to the relevant data privacy authority if your data privacy rights are violated or if you have suffered as a result of unlawful processing of your Personal Data;
16.1.4. withdraw your consent to the processing of your Personal Data (where 1app are processing your Personal Data based on your consent);
16.1.5. in some cases, request the restriction of the processing of your Personal Data, or object to that processing; and
16.1.6. request receipt or transmission to another organization, in a machine-readable form, of the Personal Data that you have provided to us where 1app are using your Personal Data based on consent or performance of a contract.
16.2. Where you are given the option to share your Personal Data with us, you can always choose not to do so. Suppose 1app has requested your consent to process and later decides to withdraw it. In that case, 1app will respect that choice according to our legal obligations.
16.3. However, choosing not to share your Personal Data with us or withdraw your consent to our use of it could mean that 1app are unable to perform the actions necessary to achieve the purposes of processing described in Section II or that you are unable to make use of the Services. After you have chosen to withdraw your consent, 1app may be able to continue to process your Personal Data to the extent required or otherwise permitted by applicable laws and regulations.
16.4. 1app will screen and verify all requests beforehand. In order to verify your authority to make the request, 1app may require you to provide supporting information or documentation to corroborate the request.
16.5. Once verified, 1app will give effect to your request within the timelines prescribed by applicable laws.
17. RETENTION OF PERSONAL DATA
17.1. 1app retain your Personal Data for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or allowed by law. Once your Personal Data is no longer necessary for the Services or Purposes, or 1app no longer has a legal or Business purpose for retaining your Personal Data, 1app take steps to erase, destroy, anonymize or prevent access or use of such Personal Data for any purpose other than compliance with this Policy, or for purposes of safety, security, fraud prevention and detection, in accordance with the requirements of applicable laws.
18. PROTECTION OF PERSONAL DATA
18.1. 1app will take reasonable legal, organizational, and technical measures to ensure that your Personal Data is protected. This includes efforts to prevent Personal Data from getting lost or used or accessed in an unauthorized way. 1app limits access to your Personal Data to our employees on a need-to-know basis. Those processing your Personal Data will only do so in an authorized manner and are required to treat your information with confidentiality.
18.2. Nevertheless, please understand that the transmission of information via the internet is not completely secure. Although 1app will do our best to protect your Personal Data, 1app cannot guarantee the security of your Personal Data transmitted through any online means; therefore, any transmission remains at your own risk.
19. INTERNATIONAL TRANSFERS OF PERSONAL DATA
19.1. Your Personal Data may be transferred from the country, state and city ("Home Country") in which you are present while using our Services to another country, state and city (" Alternate Country").
19.2. When 1app transfer your Personal Data from your Home Country to the Alternate Country, 1app will comply with our legal and regulatory obligations in relation to your Personal Data, including having a lawful basis for transferring Personal Data and putting appropriate safeguards in place to ensure an adequate level of protection for the Personal Data. 1app will also ensure that the Alternate Country recipient is obliged to protect your Personal Data at a standard of protection comparable to the protection under applicable laws.
19.3. Our lawful basis will be either consent (i.e. 1app may ask for your consent to transfer your Personal Data from your Home Country to the Alternate Country at the time you provide your Personal Data) or one of the safeguards permissible by laws.
20. AMENDMENTS AND UPDATES
20.1. 1app shall have the right to modify, update or amend the terms of this Policy at any time by placing the updated Policy on the websites. By continuing to use the Apps, Websites or Services, purchase products from 1app or continuing to communicate or engage with 1app following the modifications, updates or amendments to this Policy, you signify your acceptance of such modifications, updates or amendments.
21. DISCLAIMERS
21.1. The company does not, and cannot, guarantee the security of your personal data any other information that you may provide either to us or to any third party. While we have implemented reasonable technical, organizational and physical measures to prevent the loss, misuse, and unauthorized access, use, disclosure,

The company will not be liable for any loss that the user may incur as a result of a third party’s use of their 1app account or password, whether authorized or unauthorized, without fault or negligence on the part of the company.
21.4. The user may be held liable for any loss or damage incurred by the company in connection with or arising from a third party’s use of the user’s 1app account of password, without fault or negligence on the part of the company.
21.5. The company may work with third parties to provide you with the 1app services or to enable the proper functioning of the 1app facility. We have no control over these third parties, each of which has independent and separate privacy policies. Therefore, you access these 1app facility, 1app applications and 1app services at your own risk. The company has no responsibility or liability for the content, security arrangements and activities of these third parties.
